SPAK breaks down the second file that sank Vangjush Dako

Today SPAK has officially announced the arrest of Vangjush Dako and five other people, among them a businessman and four officials and former officials of the municipality of Durrës. There were two criminal facts that arrested them and more specifically the procedure of granting the permission to build a multi-storey building and completing its documentation up to the registration of the property as well as the procurement procedure Consultancy service for the provision of the project "Design implementation for the Coastal Promenade and the public beach from Bërryli to Currila" with a limited fund of ALL 21,000,000 including VAT.

But where were the violations in the tender?

SPAK says that it was found that in 2014, Durrës Municipality has carried out a procurement procedure, for consultancy service, the provision of a project called "Implementation design for the Coastal Promenade and the public beach from Bërryli to Currila".

In view of this, the Mayor of Durrës Dako has set up a working group composed of municipal officials whose task was to determine the terms of reference and the limit fund, based on VKM No. 444 dated September 5, 1994.

"In fact, due to some errors in the calculation, the study fee and the value of the limit fund, was calculated ten times higher than it should have been, according to the criteria of the Decision of the Council of Ministers" says SPAK.

But the procedure continued. "The procurement procedure was announced with a limit fund of 21,000,000 lek, determined and in the procurement order signed by the person under investigation Dako and at the end of the procedure, the company "XXX sh.pk" was declared the winner.

The procedure continued with the conclusion of the contract, Article 5 of which provides that 60% of the value would be repaid at the time of signing the contract and 40% in the next budget year.

In the month of May 2015, according to a hearing of the High State Control, an irregularity in the calculation of the limit fund was found, leaving the Durra Municipality administration to recover the economic damage.

Në lidhje me këtë fakt, por sipas akuzës rezulton se në bashkëpunim midis tyre, personat nën hetim Vangjush Dako, Adhurim Qehahaj, ish-shef i urbanistikës, Diana Dedja dhe Adnand Toçila kanë konsumuar në bashkëpunim elementët e figurës së veprës penale të  “Shpërdorimit të detyrës” parashikuar nga neni 248 dhe 25 të K.Penal.
