Our country still does not have modern infrastructure. Computerization is still low. The physical distances are such that Tirana can be reached in half a day. The means of transport are still in poor condition. The trip is not comfortable. In these circumstances, the journey to the Court of Appeals alone would be a real torture that would be called the Court of Appeals in Tirana or the horror of citizens in search of justice that would resemble those who seek through the woods the path to get out by candlelight in hand on the main road. In the name of concentration in our country, many experiments have been done and all of them have been accompanied by wandering and toil of the citizens. Bureaucracy has increased and forms and schemes that time has rendered as unnecessary and ineffective have been experimented with. These are concentrations that have been sold as profound reforms but have been accompanied by endless difficulties in finding the necessary services, many times vital to our citizens. But the concentration of the Courts of Appeal for the whole of Albania in the capital would be an extreme and unaffordable measure for the citizens. In these circumstances, such a project only bureaucratizes and complicates justice. This concentration is not a solution for the people, but a negative consequence for them.

Janë 29 gjykata të faktit, pothuaj në shumicën e bashkive dhe gjashtë gjykata Apeli. Propozimi për t`i reduktuar gjykatat e Apelit në një të vetme me qendër në Tiranë, nuk është reformim, as zgjedhje, po një veprim që mund të merret nga organet e drejtësisë për mungesë të magjistratëve dhe largimeve të shumta nga sistemi, disa prej vetingut dhe dorëheqjet për mos t’u ballafaquar me efektet e reformës në drejtësi. Kjo mungesë është e përkohshme dhe përgatitja e gjyqtarëve të rinj është proces që nuk ndalet. Shumë shpejt kontingjentet e nevojshme me gjyqtarë do përgatiten e specializohen dhe numri i tyre do jetë i mjaftueshëm për të plotësuar boshllëqet, vakancat, siç thuhet në gjuhën e drejtësisë. Pra numri i munguar sot mund të plotësohet në muajt e ardhshëm, duke mos mbetur gjykata me personel të reduktuar. Ndërsa projektit për një gjykatë Apeli vetëm në kryeqytet është nonsens. Shqipëria edhe pse një vend i vogël, prodhon përditë qindra problematika të karaktereve të ndryshme konflikte, pronësi, me administratën, përballje me shkeljet e Kodit të Punës dhe mijëra problematika, të cilat përfundojnë në dyert e gjykatave.

Le të mendojmë për një çast të vetëm në se çdo qytetar i Republikës së Shqipërisë nga Konispoli në Vermosh nga Erseka në Divjakë nga çdo cep i vendit të shkojë për gjykim në Apelin e Tiranës. Çfarë rrëmuje e jashtëzakonshme, sorollatje, ecejake, shpenzime, kilometra të përshkuara, autobuza, hotele, restorante që duhet të frekuentojë për një kontakt edhe formal në Gjykatën e vetme të Apelit në Tiranë një shtetas. Ky pelegrinazh i pakrahasueshëm është vërtetë i dhimbshëm, është shpërdorimi më i madh i energjive të qytetarëve që do bredhin me dosjet nën sqetull për t`u paraqitur para togave të zeza të Apelit në Tiranë. Që tani që e dëgjojnë si projekt, diskutim, shkëmbim mendimesh mes organeve të drejtësisë, Ministrisë së Drejtësisë dhe grupeve të interesit, qytetarëve, u ngjethet mishi për atë që i pret dhe luten të mos ndodhë dhe projekti të mos miratohet. Mund të thuhet se përqendrimi rrit cilësinë e gjykimit dhe zhduk korrupsionin dhe rrit kontrollin e proceseve gjyqësore, po ky është vetëm një iluzion, i cili nëse bëhet realitet koha do provojë se është vendimi më i padrejtë dhe shumë shpejt praktika do ta zhbëjë si akt që përqendron gjykatat dhe rropat qytetarët, të cilët nuk mund të përballojnë eksperimente të tilla. Shumë vite të shkuara pas vendosjes së pluralizmit me ndryshimin e sistemit dhe instalimin e pluralizmit politik, përgatitjen e gjyqtarëve në plepa plazhin e Durrësit, u eksperimentua edhe krijimi i Gjykatës së Kasacionit, ku shqiptarët vraponin drejt Tiranës në kërkim të drejtësisë. Në këtë gjykatë, numri i gjykimeve ishte i pafund. Dhe nuk kaloi shumë kohë dhe sistemi u zhbë.
