DP lawyer Indrit Sefa explains the details of how Berisha lost the DP in court, here is what will happen to "Foltoren" after the Appeals trial

Democratic Party's lawyer, Indrit Sefa stated that any decision taken by Sali Berisha is invalid, as there is still no final decision regarding the DP statute. During an interview for the newspaper "SOT", lawyer Sefa said that accepting Enkelejd Alibeaj's appeal was a fair decision, emphasizing that they have two requests, either the reversal of Zhukri's decision or the case be returned to the Court of Appeals with another panel. . Also, Mr. Sefa says that in the register of political parties, PD is still represented by the current structures and governing bodies, while the Re-establishment Commission does not appear. According to him, without being recognized by the "Appeal" decisions of December 11, any decision of the Re-establishment is invalid.

-Z. Sefa, the court accepted on Tuesday the lawsuit filed by the lawyer of "Foltore", Ivi Kaso, who seeks the rejection of the appeal of the commanding leader of the Democratic Party, Enkelejd Alibeaj? What does this decision look like?

The Tirana Judicial District Court did not accept the appeal made by the Re-establishment Commission, but simply administered it in the file. It can also inform you that the Re-establishment Commission has carried out a counter-complaint which has been communicated to us by the court and has also appealed Decision no. No. 508 Register dated 22.4.2022 of Judge Blerina Muça. In point 2 of this decision it is clearly stated that no appeal is filed against this decision but the Re-establishment Commission has found it reasonable to make such a procedure which is not based on any legal provision.

-What are you asking for as an official DP and has your complaint been accepted?

The appeal made by the Democratic Party against the decision No. 3 dated 25.3.2022 given by Judge Agron Zhukri was accepted by the court through the decision with No. 508 Register dated 22.04.2022. After this decision-making pursuant to the Code of Civil Procedure and Decision No. 222 dated 6.11.2019 of the Court Council, the court file reviewed by Mr. Zhukri will go to the Court of Appeals, where it will be this court that will decide finally regarding the legality of the December 11 Assembly. The Democratic Party has requested from the Court of Appeals to overturn the decision with No. 3 dated 25.03.2022 of Judge Agron Zhukri and to dismiss the case.

-If Zhukri's decision is overturned, what will happen?

Vendimi me Nr.3 datë 25.03.2022 i gjyqtarit Agron Zhukri nuk ka dhënë asnjë pasojë juridike, pasi ai nuk është i formës së prerë dhe nuk është pasqyruar në Regjistrin e Partive Politike dhe juridikisht çdo vendimmarrje e Komisionit të Rithemelimit nuk ka asnjë efekt ligjor dhe është nul. Siç mund ta shihni Komisioni i Rithemelimit nuk njihet nga asnjë institucion publik dhe ndërkombëtar, pasi nuk ka tagra të përfaqësojë Partinë Demokratike.

-A është alarmuar “Foltorja” e nisur nga sulmet e ish-kryeministrit Sali Berisha ndaj gjyqtares Blerina Muça?

Nuk kam ndonjë interes për situatën psikologjike të Z. Sali Berisha por një reagim i tillë nuk ndodh për herë të parë dhe me siguri nuk ka për të qenë i fundit. Qëndrimi i mbajtur gjatë takimit të zhvilluar në zyrën e Sekretarit të Përgjithshëm në datën 25.3.2022 është në kundërshtim total më reagimet nervoze të kohëve të fundit. Z. Berisha në atë takim ka kërkuar respektimin e vendimeve të gjykatave dhe një garanci e tillë është dhënë si nga Kryetari i Komanduar Z. Alibeaj ashtu dhe nga Sekretari i Përgjithshëm Z. Bardhi, të cilët gjithashtu kanë i kanë konfirmuar se ndaj vendimit të dhënë nga  gjyqtari Agron Zhukri, PD do të ushtrojë të drejtën e ankimit.

-Gjykata gjithashtu ka bërë thirrje për të ndalur sulmet ndaj saj. A rrezikon që presioni i "Foltores" të ndikojë në vendimmarrje e togave të zeza?

Kërkesa e gjykatës është legjitime dhe unë besoj që është detyra e palëve në proçes të ngrihen në lartësinë e detyrës së tyre  për të ndaluar menjëherë sulmet ndaj saj. Unë mendoj që vendimet e gjykatës mund të komentohen por në të gjitha rastet ato do të duhet të zbatohen nga të gjitha palët pavarësisht vendimarrjes së saj. Unë shpresoj që Gjykata e Apelit do jetë në lartësinë e detyrës dhe dëshirojë që kjo gjykatë t’i jap zgjidhje përfundimtare kësaj çështje në një kohë sa më të shkurtër.

-Ndërkohë edhe zoti Gazment Bardhi, ka ngritur alarmin dhe deklaruar se Sali Berisha po ushtron presion ndaj gjykatës për këtë çështje. Sa qëndrojnë këto pretendime?

You can see for yourself from the public attitudes of Mr. Sali Berisha, who constantly attacks any judge who does not think like him or who has made a decision that he does not like. For Mr. Berisha a decision based on law is only the one that is in his favor otherwise the attacks and rhetoric are of unprecedented aggressiveness. Today, for 30 years, this attitude towards the courts and the judiciary in general has been Sali Berisha's modus operandi towards me and such behavior does not surprise me.
