I pyetur nga gjykatësja Colleen Kollar-Kotelly, nëse më 25 nëntor, ai kishte “informuar Prokurorin e Departamentit të Drejtësisë … për një hetim të mundshëm kriminal për një shtetas amerikan, që ishte regjistruar për të bërë lobizëm ‘për një parti që nuk ishte e kryeministrit Rama’, zoti McGonigal u përgjigj “Po”. Zoti McGonigal kishte marrë informacion për këtë lobist nga zoti Duçka. Në akt-padi nuk identifikohet lobuesi amerikan dhe as partia shqiptare. Por më 14 nëntor të vitit 2017, lobisti Nick Muzin, depozitoi në Departamentin e Drejtësisë, ndonëse me vonesë, dokumentet mbi aktivitetin lobues të disa muajve më parë për llogari të PD-së, i cili më pas është bërë subjekt hetimi në Shqipëri për origjinën e parave. Më 26 shkurt 2018, zyra e FBI-së në Nju Jork hap zyrtarisht hetime të përqendruar tek lobisti amerikan me kërkesën dhe nën udhëzimin e zotit McGonigal. Gjatë seancës zoti McGonigal pranoi se i kishte krijuar lidhjet dhe kontaktet në Shqipëri përmes një mikut të tij, duke iu referuar Nezës, me synimin për të përgatitur terrenin që pasi të largohej nga FBI-ja të ndiqte mundësi biznesi dhe përfitimesh në Shqipëri. Zoti McGonigal pranoi në seancë faktin që ishte takuar disa herë me Kryeministrin Edi Rama.
