Democratic MP Agron Shehaj presented yesterday in the Committee for Legal Affairs, Public Administration and Human Rights the draft law "On the identification of beneficial owners of partners in the public sector", otherwise known as the draft law against the inclusion of "offshore" companies in public tenders and concessions . Shehaj justified the approval of this draft because of the increase in high state corruption and the great economic damage caused to the state budget by contracts with "shell" companies. In addition, the deputy of Tirana added that socialist politicians benefit from these concession contracts, since they are the real owners of these "offshore" companies. His key proposal in this draft law is the exclusion of entities competing in tenders if they do not make public the names of the owners.
Shehaj: Politicians have benefited 1 billion euros from offshore tenders
During the speech at the Law Commission, Shehaj stated that the concessions obtained by "offshore" companies have produced a great corruption. Behind these companies, Shehaj accuses politicians who have benefited so far 1 billion euros. "Corruption in Albania is the major problem in Albania. Politicians should not take advantage of it, as there are over 1 billion euros that go to individuals who are unknown," declared the democratic deputy. On the other hand, the head of the Laws Committee, Klotilda Bushka, decided that in the next session, the draft law of Shehaj and that of the democratic deputy Jorida Tabaku on the attack on corrupt concessions will be brought together for discussion. Shehaj: Behind every 'offshore' company hide politicians, ministers or their family members
Then, MP Agron Shehaj appeared on "News 24". He reasoned that he has proposed this draft law prompted by the major corruption in Albania and the pressure of the West on the Albanian state to fight this problem and the fact that Albanian citizens have an irrefutable conviction that their political class is financially corrupt. "The law aims to prohibit the participation of 'offshore' companies in public tenders, as they are companies where the shareholders are anonymous. So, if the names of the beneficiaries are not made public, they should not continue. Shareholders of offshore companies choose to be hidden, because they do not want it to be known that they are receiving money from the state budget. Behind every 'offshore' company, there is a government official, minister, prime minister, family member or a partner of theirs, because there is no other reason for someone to keep their name secret. In the situation we are in, there is a conviction among citizens who think that politicians are corrupt", declared Shehaj in "News 24".
What does the draft law of Agron Shehaj provide?
1) General provisions; 2) It aims to increase transparency; 3) Defines the scope of implementation of this draft law; 4) Definitions of some terms that are new and those that have been reformulated; 5) Sanctions the basic principle of this law, the principle of transparency; 6) Continuous updating of the public sector; 7) Competences of responsible or control authorities are defined; 8) This provision provides for administrative sanctions and cases where violations are identified in order to discourage subjects from not complying with the law; 9) In case the subjects do not declare the owners, to be disqualified from the administrative process; 10) Public contracts extended in time, the law gives a deadline for the declaration of the owners, if they do not do it within the specified time they will be disqualified.
