SPAK has been set in motion to investigate the deadlocks in the vetting. A few days ago, official representatives of the European Union and MEPs of the European Parliament gave an ultimatum to SPAK to take action regarding those left behind in the vetting. Their call has not fallen on "deaf ears", as it seems that SPAK has set in motion yesterday to investigate those stuck in the vetting process, as the fight against corruption and organized crime is one of the main conditions for the opening of the country's negotiations with the EU. Yesterday, the Court Against Corruption and Organized Crime took the former judge of the Supreme Court Shkëlzen Selim as a defendant. He is accused by SPAK of committing the criminal offense of "refusal to declare, non-declaration, concealment of wealth.
Selim's property is seized
Selimi was dismissed by the Independent Qualification Commission on the basis of evidence of links with elements of organized crime in Fier, considering the former judge as unfit to continue exercising his function. After the decision of the KPK, SPAK started investigations and seized Selim's property, the plot of land with an area of ??432 m2 and the fuel of 132.25 m2 on the Lungomare promenade in Vlora. Also a plot of land with an area of ??2400 m2, consisting of a combination of properties, in Jonufr, Vlora, owned by Kujtim Selim and another plot of land with an area of ??764 m2 and fuel with an area of ??57 m2 on the Transbalkanic road in Vlora, owned by his relatives. Remember Selimi. SPAK, implementing the anti-mafia law, seized ½ of a fuel tank on Lungomare Promenade in Vlora. Since the former judge was dismissed only for the purity of his image, fuel was not the subject of discussions during the sessions of the vetting process. The former judge bought the fuel in 2013 for 250,000 euros. He claimed as the source of a loan worth 6.6 million lek, the sale of an apartment and a garage in Vlora at a price of about 79 thousand euros, as well as his savings worth about 20 thousand euros. He leased the fuel worth about 60 thousand USD per year.
Criminal acts
On the other hand, the newspaper has checked all the decisions made by the Independent Qualification Commission, where it is clearly shown that the vast majority of those excluded from the system have committed criminal offences. Apart from those who were excluded for contacts with crime or professional skills, all those who remained because of wealth committed crimes. All of them risk being accused of concealment and non-declaration of income. "Refusal to declare or non-declaration of property, private interests of elected persons or public servants or any other person who has the legal obligation to declare according to the law, when administrative measures have been taken before, constitutes a criminal offense and is punishable by a fine or imprisonment up to 6 months. Concealment or false declaration of assets, the private interests of elected persons and public servants or of any other person who has the legal obligation to declare, shall be punished by a fine or imprisonment of up to three years", it is stated in Article 257/a of the Criminal Code. It also turns out that some have falsified forms, falsified documents and committed violations with loans. Some have defrauded banks with loans, while some have obtained soft loans in violation of the law. A part turns out to have committed fiscal evasion, as they have avoided taxes by cheating with the property surfaces. According to the provisions of the Criminal Code, non-declaration of assets or false declaration is punishable by up to 3 years in prison. Forging the form is punishable by up to 4 years in prison. Document forgery is punishable by up to 3 years in prison. And credit fraud is punishable by up to 7 years in prison.
