About 620 convicts will benefit from the amnesty, after the final version of the draft law on criminal amnesty, this figure increased compared to the proposal of a few weeks ago. Yesterday, the Ministry of Justice submitted the final version to the Prime Minister where, according to Minister Ulsi Manja, the recommendations requested by SPAK, KLJ and the General Prosecutor's Office were reflected. "We have reflected the recommendations requested by SPAK, KLJJ and the General Prosecutor's Office, making it a more complete amnesty, from which 620 convicts will benefit", emphasized Minister Manja.
Here's who benefits
Through this amnesty, men sentenced to imprisonment of up to 3 years or any other type of lighter punishment, including a fine or one of the alternatives to imprisonment, for sentences given up to on 30.11.2023, regardless of the time remaining from the sentence. It also benefits men sentenced to imprisonment, who, until the date of entry into force of this law, have not suffered from this sentence for up to 3 years. Also convicted men who, on the date of entry into force of this law, are equal to or over the age of 60. While benefiting from and exempt from serving the sentence, women sentenced to imprisonment for up to 4 years or any other type of lighter punishment, including a fine or one of the alternatives to imprisonment, for sentences given up to 30.11. .2023, regardless of the time remaining on the sentence. While the women sentenced to imprisonment, who, until the date of entry into force of this law, have not suffered from this punishment for up to 4 years. Likewise, convicted women, who, on the date of entry into force of this law, are equal to or over the age of 50. Likewise, persons sentenced to imprisonment, who, at the time of committing the criminal offense, were equal to or under the age of 18.
Here is who is penalized
Meanwhile, the amnesty cannot benefit those convicted of crimes against humanity, crimes against life committed intentionally, which includes murders. Those who have committed crimes against health, sexual crimes, hostage-takers, against morality, dignity, children, marriage and family are not amnestied. The Ministry of Justice proposes that those convicted of criminal groups and crimes against the state, falsification of documents, violating the legal regime of land and construction or against the environment cannot benefit. Convicts who do not have any right to amnesty are also those who have committed crimes against independence and constitutional order, who have violated relations with other states, terrorism, crimes against state authority or against justice. The amnesty, which is expected to be voted on by the Assembly, does not reduce the sentence even for those who affect free elections, crimes by armed gangs and criminal organizations. Those who have avoided criminal prosecution and those who are forced to declare their assets and entities judged by the Court against Corruption and Organized Crime and investigated by SPAK do not benefit from a reduced sentence.
