The European Union has started to "play its hands" so that Serbia and Kosovo reach a final agreement. Yesterday, both Belgrade and Kosovo received clear instructions. In Belgrade, everyone is alarmed because the European Union will ask the European Commission to include the obligations from the agreement on the normalization of relations between Serbia and Kosovo, in the membership negotiations between Belgrade and Brussels. So if the Serbs do not recognize Kosovo, there is no integration in the EU.
Serbia is shocked
On the eve of the December 17 parliamentary elections, the member states of the European Union will propose that Serbia's negotiating framework for membership include the implementation of the agreement on the normalization of relations with Kosovo. This proposal is expected to be made at the December 12 meeting in Brussels of the Council for General Affairs and then it must be approved by EU leaders at the European Council summit that will take place on December 14 and 15. The agreement between the two neighboring states of 11 articles reached in Ohrid, among other things, foresees a level of self-management for the Serbian community in Kosovo as well as mutual recognition of state symbols. The President of the European Commission, Ursula von der Leyen, has called on Serbia to "de facto" recognize Kosovo. An alarmed Vucic declared yesterday that he does not think it is possible for the Ohrid Agreement as a whole to be included in Chapter 35, because, as he said, this would de facto close the door to Serbia. "If you include that Kosovo's membership in the UN is part of chapter 35, then it is clear to us that you do not want Serbia. I don't believe it's possible and I just think that such a decision will not be made," said Vucic.
What is required of Kosovo?
On the other hand, the European Union has delivered to the opposition parties in Kosovo, a copy of the draft statute of the Association of municipalities with a Serbian majority, after many rumors that the negotiations in Brussels were kept secret and there was not much transparency about it. But what does this draft contain? This document for the establishment of the Association should provide a certain level of self-management to the Serbian community in Kosovo. Among other things, he clearly foresees the possibility of financial support of the Association from Serbia, as well as "an efficient and direct channel of communication between the Kosovo Serb community and the Government of Kosovo through the Ministry of Local Self-Government Administration". His powers are the reasons why the authorities in Kosovo have refused, until now, to form the Association.
The part of the Association's draft statute that refers to its powers specifies that this body has the right to approve decisions, regulations, instructions and declarations. It also has full powers on the local level, namely in the fields of economic development, spatial planning, health , education and protection of cultural and religious identity. In the section on relations with the central government, it is stated that the Association will not violate or bypass the constitutional and legal authorities and their powers, and will not in any way violate the constitutional and legal relations between the central and local governments, during fulfilling its goals.
Based on the draft statute, the Association of Serb-majority municipalities, in addition to its symbols, will also have the assembly, the president and the vice-president, the advisory mechanism, the administration and the complaints office. In addition to saying that the Association will not be a third level of government, emphasis is also placed on the issue of management of educational and health institutions in Kosovo. These institutions are almost the only ones that have never been integrated into the Kosovo system. All educational institutions in the Serbian communities in Kosovo operate under the Ministry of Education of the Government of Serbia. This includes: preschool institutions, primary and secondary schools, as well as the university based in North Mitrovica.
