Changed the criminal offense for the court employee who was beaten because of his duty, ILD starts the verification for the Prosecutor of Lezha (Name)

The High Inspectorate of Justice has started verifications against the prosecutor of Lezha, Irena Sufaj, with the suspicion that she violated the law.

According to the sources, it is about a criminal proceeding of assault due to the duty of a court employee, an event that occurred in October 2023. For the case in question, one day before the end of the investigation deadline, the prosecutor of Lezha, Irena Sufaj, decided to change of the legal definition of the criminal offense from "Assault due to duty" provided by article 237 of the Criminal Code, in article 90 of the Criminal Code "Other intentional damage" and contrary to the law, the prosecutor did not communicate this decision to the victim of the offense criminal.

Also, one day after changing the legal definition of the criminal offense and without communicating this decision to the victim, the prosecutor completed the investigations and at the same time decided to dismiss the case for the author of the event.

Referring to the criminal procedural law, for the change of the legal definition of the criminal offense, the prosecuting body, upon making the decision, had to inform the victim, and for the right to be familiar with the act and, as the case may be, to file an appeal with the Court, but this is not happened in the case in question.

For this reason, this criminal proceeding and these decision-making of the prosecutor Irena Sufaj have become the object of verification by the High Inspectorate of Justice.

Meanwhile, this decision has been appealed by the injured party in court, and despite the fact that more than two months have passed, the date of the court session has not yet been set, exceeding any legal deadline.
